River North Studios Hire Terms and Conditions

 

Definitions

The “Hirer” is the customer who is hiring the studio and equipment from River North Studios.

The “Equipment” means the photographic items and the studio facilities, including any fittings, furniture, or props.

The “Hire Period” is the period for which the studio and included equipment is hired.

The “Studio” is the premises of River North Studios, 9c Meadow Works, Court Street, Trowbridge, Wiltshire BA14 8BR. River North Studios is operated by Matthew Evas Photography, which is a trading name of MCE Systems Ltd (registered in England and Wales. Registration number: 3872690).

The “Booking Fee” is the fee paid to River North Studios in return for use of the Studio and Equipment for the agreed Hire Period.

 

Booking Policy

Bookings are taken on a first come first served basis.

All bookings are payable in full at the time of booking using the booking system.

 

Reschedule / Cancellation Policy

Bookings can be rescheduled or cancelled up to 72 hours in advance of the commencement of the booking using the booking system. Any refund due will be returned to the card used to make the original booking.

 

Commercial Pricing

A booking is deemed to be commercial in nature, and priced accordingly, when: -

  • The Hirer is being financially compensated either in part, or full, for the booking, or activities taking place related to the booking.

  • The Hirer is being compensated in kind (goods, or services provided in lieu of payment) either in part or full for the booking, or activities taking place related to the booking.

  • The booking relates to the production of images that will be used by a commercial entity in any medium (print, electronic, social media, etc), even when the hirer is not being compensated by the commercial entity in any way.

 

Hirers Responsibility

It is the responsibility of the Hirer to understand the extent and limitations of the coverage before booking the studio and associated equipment. It is the Hirers’ responsibility to ensure they have adequate insurance to cover any loss, or damage, to the studio and or equipment. This insurance should also cover any other persons (either private individuals, or commercial clients). The hirer is liable for all replacement costs and against all forms of loss or damage however caused during the hire period. The hirer will pay River North Studios on demand all money the hirer may receive from an insurance company or any other source in settlement of any claim relating to the loss, theft, or damage to the Equipment or studio. The hirer must not compromise any claim without our express written consent.

The equipment is serviced regularly, and every effort is made to ensure that the Equipment & Studio is supplied in working order. River North Studios cannot be held liable for failure of Equipment, or for any consequential or sub-consequential loss there from.

It is the Hirers responsibility to ensure they know how to correctly operate the Equipment, and that the Equipment functions to their requirements.

If the Equipment is found to be defective, the hirer must notify a representative of River North Studios immediately. If the defect has not been caused by anything the hirer may have done, or failed to do, we will replace it, or repair it, as soon as reasonably possible.

Under no circumstances must the hirer repair, or attempt to repair, the Equipment unless authorised by a representative of River North Studios.

The Equipment and any furniture or props must not be removed from the Studio, or used without permission. The hirer must notify River North Studios immediately if the Equipment is involved in any accident resulting in damage to the Equipment, to other property, or injury to any person.

It is the hirers’ responsibility to ensure that all persons who use the Equipment are properly instructed in its safe and correct use, and that the hirer has requested and received adequate instruction on its safe and correct use. The hirer must ensure that the Equipment is not misused, and that supervision is adequate at all times.

It is the hirers’ responsibility to ensure that the Equipment is suitable for the purpose for which the hirer intends to use it, and that the hirer will give us sufficient information to ensure that the Equipment supplied is suitable for that use.

The Hirer assumes responsibility for the Studio and Equipment, and it begins at the commencement of the hire period. The hirers responsibilities include safe keeping of the Equipment, and protection against the elements of theft, vandalism or improper use. The hirer is responsible for the return of the Equipment in the same condition as at the start of the hire period. The Equipment remains the property of River North Studios at all times.

The hirer will indemnify River North Studios against any and every expense, liability, financial loss, claim or proceedings whatsoever, and in respect of any death or personal injury whatsoever, or damage to our loss of property whatsoever arising out of the use or non-use of the Equipment, or any parts of it.

Equipment lost, stolen, or damaged while in the Hirer’s possession will be the entire responsibility of the Hirer.

Any Equipment not returned at the end of the Hire Period will automatically be charged to the Hirer’s invoice at the full current replacement cost.

The hirer will not remove, deface, or cover up any branding, or name plate, within the Studio, or on the Equipment indicating that it is the property of River North Studios, or damage or deface the studio premises, fittings, furniture, or props in any way.

All goods are advertised subject to availability. River North Studios reserves the right to change both the prices and the Equipment available for hire without prior notice.

The hirer is liable for any damage arising from breakage of flash tubes and/or bulbs.

River North Studios can not be held liable for any disruption to the hirers booking caused by a third party, nor can we be liable for any loss or damage to any personal equipment or items during the Hire Period.

River North Studios will not be liable for any direct or indirect loss of business profits that the hirer expects to make, wasted money, wages, fees or expenses due to unsuitability, breakdown or stoppage of the Equipment, or any part of it.

River North Studios will not be liable for any delays caused by any circumstances beyond our control.

A representative of River North Studios will be present within the premises for all bookings.

The Hirer agrees to leave the studio in a clean and tidy condition. Should this not be the case, the hirer agrees to pay River North Studios a cleaning fee of £40 per hour (min 1 hour).

Acceptance of the Equipment by the Hirer signifies the total acceptance of these terms and conditions for hire and excludes any terms and conditions the hirer may have put forward except where we have agreed to any amendments, or other conditions in writing.

 

Acceptable Use

River North Studios operates a “no adult” policy relating to the creation of images which could be considered to be of an adult nature. If in doubt, please ask for clarification.

If a booking is found to be taking place which involves the creation of images which are deemed to be of an adult nature, the booking will be terminated with immediate effect. The Hire Fee will not be refunded either in part, or full. Any decision relating to this matter will be made by a representative of River North Studios, and is final.

 

Acceptance of Terms

By making a booking, and subsequent payments, the Hirer agrees to be bound by the terms and conditions stated above. Any booking which breaches the Terms and Conditions of River North Studios will result in the immediate termination of the booking, with loss of the Hire Fee.
